Denied Payment by Your Insurance Provider?
Recover the Benefits Owed You Through a "Bad Faith" Claim
Insurance companies are legally bound to act in the best interests of the clients they represent and deliver the compensation they're contracted for. When this doesn't happen, the company is said to have acted in "bad faith" and can be held liable for the benefits they've withheld. This is true in regard to property insurance, auto insurance, health insurance, disability insurance, long-term care insurance, and life insurance.

Louisiana Bad Faith Statutes
According to LA.REV.STAT.SS 22:1892 and 22:1973* in Louisiana, there are penalties for those who arbitrarily or capriciously fail to pay a claim. The Louisiana Supreme Court notes that these statutes both incorporate the same standard and conduct. Whether your insurance company failed to adequately cover you in the aftermath of a vehicular accident, a property damage claim or a death in the family, you may be entitled to punitive damages beyond what was originally specified in your contract.
Examples of bad faith practices include:
- Taking an inordinate amount of time to process a claim
- Failing to adequately cover the cost of damages
- Delaying or denying needed treatment
- Refusing to settle
